1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of ByeFAQ (the "Service"). By creating an account, accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" refers to that organisation.
If you do not agree to these Terms, you must not use the Service.
2. The Service
ByeFAQ lets you store and index your own content — including documents, notes, written articles, uploaded files and content imported from websites — and expose that content through AI-powered assistants and an embeddable chat widget.
You are responsible for configuring your assistants, selecting which content they can access, and for the answers they generate from the content you provide.
3. Your content
You retain ownership of all content you upload, write, import or otherwise make available through the Service ("Your Content"). You grant ByeFAQ a worldwide, non-exclusive licence to host, store, process, index, embed and display Your Content solely for the purpose of operating and providing the Service to you.
You are solely responsible for Your Content and for ensuring you have all rights, licences and permissions necessary to use it with the Service.
4. Website crawling and third-party content
A core feature of the Service allows you to import content from websites by submitting a URL for crawling and indexing. Because that content may be owned or controlled by third parties, the following terms apply specifically to it. By submitting any URL to be crawled, you represent, warrant and agree that:
- You own the website, or you have obtained all necessary rights, permissions, consents and licences to crawl, copy, store, index and use its content through the Service.
- Your crawling and use of the content complies with the target website’s terms of service, robots.txt directives and all applicable laws, including copyright, database and data-protection laws.
- You will not submit URLs for websites that you do not own or are not authorised to crawl.
- Any personal data contained in crawled content has been collected and may be processed lawfully, and you have any consents or legal bases required for that processing.
You acknowledge that the crawl is performed at your instruction and on your behalf. ByeFAQ acts solely as a technical processor carrying out your request and does not select, review, endorse or verify the content of any website you submit.
ByeFAQ takes reasonable, good-faith technical measures (such as identifying its crawler and respecting robots.txt) but does not warrant that any particular crawl is lawful in your circumstances — that responsibility rests with you.
5. Allocation of responsibility
As between you and ByeFAQ, you are the party responsible for Your Content and for any content you instruct the Service to crawl, store or process. ByeFAQ is not the author, publisher or owner of that content and does not control what content you choose to import.
You are responsible for responding to any complaint, claim or request relating to content stored against your account, including requests from third parties for removal of their content.
6. Indemnification
You agree to indemnify, defend and hold harmless ByeFAQ, its affiliates, and their respective officers, directors, employees and agents from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content; (b) any content you instruct the Service to crawl, store, index or process; (c) your violation of these Terms; or (d) your violation of any third-party right or applicable law, including intellectual property, privacy or data-protection rights.
7. Acceptable use
You agree not to use the Service to:
- Crawl, store or distribute content you do not have the right to use.
- Infringe the intellectual property, privacy or other rights of any person.
- Store or process unlawful, harmful, defamatory or misleading content.
- Attempt to gain unauthorised access to the Service or interfere with its operation.
8. Notice and takedown
If you believe content stored through the Service infringes your rights, please contact us with sufficient detail to identify the content and your rights in it. We will review valid requests and remove or disable access to infringing content where appropriate. We may also remove content or suspend accounts that we reasonably believe violate these Terms.
9. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. AI-generated answers may be inaccurate or incomplete, and you are responsible for reviewing them before relying on them.
10. Limitation of liability
To the maximum extent permitted by law, ByeFAQ will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Service. ByeFAQ’s total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the amounts you paid to ByeFAQ in the twelve months preceding the event giving rise to the claim.
11. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
